
Hanafi Fiqh - Societal Law (Intermediate)
Synopsis:
This is the fourth and final module of the WLSIS Intermediate Level Islamic Law
curriculum [Module 1: Worship and its Rulings, Module 2: Business Law and
Islamic Finance, Module 3: Family Law]. All four modules are based around the classical legal text of the
Hanafi school of jurisprudence known as "The Summation of Al-Qaduri" (Mukhtasar
al-Qaduri). This core text is often referred to simply as 'The Book' by
practitioners of the Hanafi School, indicating its pre-eminent rank within the
school. The main commentary referred to in the course is "Al-Lubbab" of the
Damascene jurisprudent Shaykh Abdul-Ghani al-Ghunaymi (may Allah have mercy on
him).
Module 4 is split into three 15-week terms, and deals with Criminal and
Civil Law and Laws of Armed Conflct (Jihad), including legal rulings pertaining
to the appointment of a caliph or sultan. The course finishes with a few
important miscellaneous topics in Islamic Law, including Slaughtering of
Animals, Oaths, and the Permissible and Prohibited. Terms such as 'Khilafah',
'Jihad' and 'Shariah Law' have become so emotive and politicised, yet few
Muslims actually take the time to study how they were understood by the great
legal theorists of the past. By returning to the classical works of
jurisprudence, such as 'The Book', we are able to gain insights into how these
legal issues were understood when Islamic civilisation was at its height,
uncorrupted by interpretations that arose in the modern period, often in
response to colonial subjugation. After gaining this familiarity with sources
much closer chronologically to the revelatory period itself, we are then in a
better position to evaluate objectively the various modernist formulations.
It is not a pre-condition of this course to have completed the previous
modules, as each module is self-contained. Students may study each module in any
order. Completing all four modules means that the student has covered the field
of Islamic Law at an intermediate level. All teaching is in English and
translations of the core text will be issued,

Students proficient in Arabic are recommended to obtain a copy of al-Lubaab of
al-Maydani.

Students are recommended to read the chapter to be covered in the next class
from the Hidaya in preparation for the class.
